1. Acceptance of Terms
By accessing or using WS-Cloud services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Description of Services
WS-Cloud provides cloud computing services including data storage, computing resources, security features, and related services. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.
3. Account Registration
To use our services, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account with others
4. Acceptable Use Policy
You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe on intellectual property rights
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our services
- Engage in cryptocurrency mining without explicit authorization
5. Payment Terms
You agree to pay all fees associated with your use of our services. Fees are billed in advance on a monthly or annual basis. We reserve the right to change our fees with 30 days notice. Failure to pay may result in service suspension or termination.
6. Service Level Agreement
We strive to maintain 99.99% uptime for our services. If we fail to meet this commitment, you may be eligible for service credits as outlined in our SLA document. This is your sole remedy for service unavailability.
7. Data Ownership and Backup
You retain all ownership rights to your data. We will not access or use your data except as necessary to provide services or as required by law. You are responsible for maintaining backups of your data. We provide backup services, but recommend maintaining your own independent backups.
8. Intellectual Property
All intellectual property rights in our services, including software, documentation, and trademarks, remain our property. These Terms do not grant you any rights to use our trademarks or branding without written permission.
9. Limitation of Liability
To the maximum extent permitted by law, WS-Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
You may terminate your account at any time through your account settings. We may terminate or suspend your account immediately if you breach these Terms. Upon termination, your right to use our services will cease, and we may delete your data after a reasonable grace period.
11. Indemnification
You agree to indemnify and hold WS-Cloud harmless from any claims, damages, losses, and expenses arising from your use of our services, violation of these Terms, or infringement of any rights of others.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through our services. Your continued use of our services after such changes constitutes acceptance of the new Terms.
